These Terms of Service (“Terms”) govern your access to and use of the website at smartharmonyai.com and the mobile applications and services provided by Smart Harmony AI (“Smart Harmony AI”, “we”, “us”, or “our”) (collectively, the “Services”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You agree not to:

• use the Services for any unlawful, harmful, or fraudulent purpose;
• interfere with or disrupt the integrity or performance of the Services;
• attempt to gain unauthorized access to any systems or data;
• reverse engineer, resell, or misuse the Services except as permitted by law.

Accounts

Some features may require an account. You are responsible for keeping your credentials secure and for activity that occurs under your account. Notify us promptly of any unauthorized use.

App stores

Apps downloaded through the Apple App Store or Google Play are also subject to those stores' terms. Purchases, subscriptions, billing, and refunds for in-app purchases are handled by Apple or Google under their policies. Where an App is licensed through the Apple App Store, Apple is not responsible for the App or its content, and Apple's standard Licensed Application End User License Agreement applies to the extent required.

Products and reselling

Smart Harmony AI operates as an online reseller of physical products, including electronics, games, toys and baby products. Where we sell through third-party marketplaces (such as Amazon, eBay or Walmart), your purchase forms a contract on that marketplace and is also subject to the marketplace's terms. Product descriptions, pricing, availability, shipping and returns for those items are governed by the listing and the marketplace's policies at the time of purchase. We sell only genuine, brand-name products and are not affiliated with, or endorsed by, the brands we resell unless expressly stated. Order support, cancellations, refunds and returns for marketplace purchases are handled according to that marketplace's process.

Subscriptions and payments

Paid features may be offered on a subscription or one-time basis. Prices are shown before purchase. Subscriptions renew automatically unless cancelled through the relevant app store before the renewal date. Manage or cancel subscriptions in your App Store or Google Play account settings.

Intellectual property

The Services, including all software, text, graphics, and logos, are owned by Smart Harmony AI or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business use. Content you submit remains yours; you grant us the rights needed to operate the Services and provide the features you request.

AI-generated output

Some Services generate output using artificial intelligence. AI output may be inaccurate or incomplete and is provided for your assistance only. You are responsible for reviewing and validating any output before relying on it, especially for important decisions. The Services are not a substitute for professional, legal, medical, or financial advice.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Smart Harmony AI and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the claim, or CAD $100 if you paid nothing.

Indemnification

You agree to indemnify and hold harmless Smart Harmony AI from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or if we discontinue the Services. You may stop using the Services at any time.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in Ontario will have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your place of residence.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
