Terms of Service

The rules for using Portrait Art, its plans, its credits and its AI-created portraits.

Last updated: October 11, 2026

Portrait Art has not launched yet. These Terms will apply from launch; nothing described here is available today.

1. About these Terms

These Terms govern your use of Portrait Art, an app by SmartHarmony AI LLC, Austin, Texas, United States (“we”, “us”). By using the app you agree to them. If you do not agree, do not use the app.

You must be at least 13 years old to use Portrait Art. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you and approve any purchase.

We may update these Terms. We will change the date above and, for material changes, tell you in the app before they take effect. If you keep using the app after that, the updated Terms apply. If you do not accept them, stop using the app and you may delete your account.

2. What Portrait Art does, and its limits

You choose a look and a photo (some looks take more than one photo), and Portrait Art uses AI (OpenAI’s models) to create a portrait in that style. You choose the look; we write the instructions sent to the AI. Results are generated by AI: they vary, may not closely resemble the person, and may contain errors or artefacts. Example images in the app were made from fictional reference sitters and show a style, not a guaranteed result. Looks may be added, changed or removed over time.

A subscription is required to create portraits, after the free trial. You can create portraits during your free trial (3 days or 3 trial credits, whichever comes first — section 5), and afterwards only while you have a Portrait Art subscription that the store reports as active or in the store’s grace period after a failed renewal. Without either, you can still open the app, browse looks, view, save and share the portraits you already have, manage or delete your account, and manage or start a subscription.

Portraits are created on our service and delivered to the app. You need an internet connection to commission a portrait. Your portraits are kept in the app on your device, with no expiry set by us, and only there: they are lost if you uninstall the app, clear its data or lose the device. Save or share the ones you want to keep, because our copy is deleted after delivery (see the Privacy Policy).

Automated photo assessment. Before a portrait is made, an automated system assesses each photo to decide whether it fits the look you chose — for example whether it shows a person with a clearly visible face, an animal for a look that includes a pet, an adult where a look needs adults, or two different people where a look needs two. It can refuse a photo. A refused photo uses no credit, and the app tells you which photo was refused and why so you can choose another. The assessment is automated and can be wrong: if you think a photo was refused in error, contact support@smartharmonyai.com and we will look into it. It does not identify anyone; the Privacy Policy explains what it does and what is kept.

People in a portrait. A portrait can include up to four people. Everyone pictured must have agreed to their photo being used (section 6).

Imagined babies and children. Some looks create an image of a baby or child who does not exist — for example an imagined baby of two people, or a person imagined as a baby. These images are fictional illustrations, made for entertainment. They are not predictions: they do not show what any real or future child will look like, and they are not based on genetics or on any medical or scientific method. They must be made only from photos of adults who have agreed to their photo being used in this way. Do not use photos of children for these looks.

3. Your account

The app creates an anonymous account for you; there is no login. Its credential is stored on your device. You can create a recovery code in the app to restore your account on another device. Treat it like a password: anyone who has it can restore your account and use its credits. Each code works once.

If you lose your device and have no recovery code, the account cannot be recovered and its credits cannot be moved to another account. We cannot identify anonymous accounts in any other way.

4. Credits

  • One portrait uses one credit; portraits that include two or more people (up to four) use two credits. The price follows the number of people in the picture, not the number of photos: a person with a pet is one credit; an imagined baby from two adults is two. The app shows the cost before you confirm, and it is not raised afterwards. Credits are used only when a portrait is delivered: a request that is refused or fails uses none.
  • Credits come with a weekly plan, and subscribers can add credits (section 5). The plans add credits for each paid week: Bronze 25, Silver 50, Gold 100. Weekly credits are added only while the store reports the paid period as active; if a renewal payment fails, no credits are added until the store confirms the payment. Added credits arrive once the store confirms the purchase.
  • Credits can be used during the free trial and while a subscription is active or in its grace period. If a subscription ends or is cancelled, the current week is not refunded and you can keep using the credits you still hold until they run out. Credits you hold when the free trial ends, if you have never subscribed, are kept and can be used once you subscribe.
  • The free trial includes 3 trial credits, added once when the trial starts. It is given once per customer.
  • Unless you subscribe, the app gives no credits.
  • If a portrait fails, is refused by our AI provider’s safety systems, cannot be started in time, or its photo is refused by the automated photo assessment (section 2), the credit or credits set aside for it are returned automatically. You are not charged for work you did not receive.
  • Each credit is backed by a limited AI processing allowance that is set aside when the credit is granted. If repeated technical failures use up that allowance, the affected credits may be temporarily unusable. They are not lost: contact support@smartharmonyai.com and we will look into it.
  • Credits have no cash value, cannot be exchanged for money, and cannot be transferred between accounts. They are a licence to use the service, not property or stored value.
  • Before the plans were introduced, Portrait Art gave 3 introductory free credits once per device. They are no longer given. Credits already in your balance are not removed by these changes.
  • Unused credits are lost if you delete your account.

5. Plans, adding credits, trial, cancellation and refunds

Plans. Portrait Art has three weekly plans, each sold as an auto-renewing subscription through the App Store or Google Play: Bronze, planned at US$24.99 per week with 25 credits; Silver, planned at US$44.99 per week with 50 credits; and Gold, planned at US$79.99 per week with 100 credits. There is no monthly, three-month or yearly plan. Prices may vary by country and store; you pay the price shown in the app and by the store before you buy, including any taxes the store applies. Family Sharing is not available. Credits are added once the store confirms the trial or the payment.

Upgrade plan. Upgrading moves you to a higher plan, with more credits every week. You change plan in your store account; the app takes you there. An upgrade applies immediately: the store adjusts the charge under its own rules, the credits already in your balance are kept, and the credits of the new plan are added once the store confirms its first paid period. A downgrade applies at the next renewal. Changing plan does not give a new free trial.

Add credits. Adding credits is separate from upgrading. While your plan is in its trial, active or in its grace period, the app offers you add-credits purchases for your plan, in several sizes, at the plan’s own rate per credit and at the price the store shows. Each is a one-time purchase: it does not renew, and it does not change your plan or its renewal date. It is offered only to subscribers of that plan. If the store nevertheless completes such a purchase for someone who is not eligible, the credits that were paid for are still added; like all credits, they need an active plan to be used.

No standalone credit packs. Standalone credit packs are not sold. A pack purchase made before this change, or completed by a store despite it, stays honoured: its credits are in your balance under these Terms.

Automatic renewal. Subscriptions renew automatically at the same price until cancelled. Every plan renews every week, and the store charges the payment method on your store account at each renewal.

Free trial. A new installation can try Portrait Art free for 3 days or until its 3 trial credits are used, whichever comes first. It needs no card and no store subscription. To give it once per customer, the app creates a random trial identifier, keeps it in your device’s protected storage (iOS Keychain; Android Block Store, which can survive reinstalling the app), and asks Apple (DeviceCheck) or Google (Play Integrity) to confirm that the request comes from a genuine device running the real app; if the device cannot be confirmed, the trial is not given. When the trial ends, creating portraits requires a subscription; the credits you still hold are kept. You can subscribe at any time, including during the trial, and then the plan’s terms in this section apply. Changing plan does not give a new trial.

Cancelling. You cancel in your store account, not in the app and not by contacting us:

  • App Store (iPhone, iPad): Settings > Apple Account > Subscriptions.
  • Google Play (Android): Google Play > Payments & subscriptions > Subscriptions.

Cancelling stops future renewals. A period you have already paid for continues to its end, and the weekly credits of that period are still added. After the subscription ends, an active plan is needed to use credits (section 4). Deleting the app or deleting your Portrait Art account does not cancel a subscription.

Refunds. Refunds are handled by Apple or Google under their policies; we cannot issue refunds for store purchases ourselves. If a payment for a plan or for added credits is refunded, the unused credits it added are removed, up to your remaining balance (your balance never goes below zero), and the weekly credits not yet added for that period are no longer added. A payment that arrives after your account was deleted is never turned into credits.

Restoring and new devices. Restoring purchases does not add credits again. A subscription belongs to your store account; credits already added stay in the Portrait Art account that received them. To keep your credits on a new device, save a recovery code beforehand.

6. Your photos and the portraits

  • Only upload photos you have the right to use. If a photo shows someone else, you must have their permission.
  • Portraits that include other people. A portrait can include up to four people, and everyone pictured must have consented. When you add a photo that shows another person — for example for a look that puts a couple, friends or a family in one picture, or one that imagines a couple’s baby — you confirm that each person shown has given you permission to upload their photo and to have it processed as the Privacy Policy describes, including the automated assessment by our AI provider and the creation of an AI-generated image of them. Having that permission is your responsibility; the app does not ask the other person. If you do not have it, do not add their photo. A portrait that depicts someone without their consent can be reported in the app or to support@smartharmonyai.com.
  • You keep whatever rights you have in your photos. You give us permission to process your photo, with our AI provider, solely to create and deliver the portrait you request, and for the short periods described in the Privacy Policy. We do not use your photos to train AI models.
  • You are responsible for how you use and share the portraits you create, including any rights of people shown in them. If you share a portrait to another service from the app (for example Instagram, Messenger, Facebook, WhatsApp or X), that service’s own terms apply to what you post there.

As between you and us, you own the portraits you create, to the extent the law grants rights in AI-generated images, and you may use them for any lawful purpose, including commercially. We claim no ownership of your portraits and do not use them for marketing or any other purpose; we handle them only to create and deliver them to you, as described in the Privacy Policy. Because similar images may be produced for other people, we cannot promise that a portrait is unique or that it can be protected as your exclusive work.

7. Acceptable use

Do not use Portrait Art to:

  • create images that are unlawful, sexual, harassing, hateful or violent, or that impersonate, deceive about or demean a real person;
  • upload photos of children without a parent’s or guardian’s permission, or of anyone without the right to do so;
  • use a photo of a child, or of anyone who has not agreed, for a look that creates an imagined baby or child;
  • get around credit limits, trial or free-credit rules or safety systems, or create accounts to obtain trials or free credits repeatedly;
  • attack, overload, scrape or interfere with the service, or reverse-engineer the app except where the law allows it.

Requests may be refused by our AI provider’s safety systems or by the automated photo assessment (section 2), in which case the credit is returned. We may suspend or close accounts that break these rules; if we close an account for a serious or repeated breach, its unused credits are lost, to the extent the law allows.

8. Availability, changes and termination

We work to keep Portrait Art available but do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features, looks or the service. You may stop using the app and delete your account at any time (see Delete your data).

Credits can be used only in Portrait Art. If we ever decide to discontinue Portrait Art, we will tell you in the app at least 60 days in advance and keep the service running during that period so you can use your credits. Subscriptions are bought through Apple or Google, so refunds for a period you have paid for are requested from them under their refund policies; we will support any such request. Credits of every kind, including trial credits and credits given before the plans, have no cash value.

9. Disclaimers and liability

Portrait Art and the portraits are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and that results will meet your expectations or resemble the person in the photo.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, portraits or goodwill. Our total liability for all claims relating to Portrait Art is limited to the greater of the amount you paid for Portrait Art in the 12 months before the claim arose, or US$50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or rights you have under consumer protection laws that cannot be waived. If you live in the European Union or the United Kingdom, you keep all of your statutory rights.

10. App Store and Google Play

These Terms are between you and us, not Apple or Google. We, not Apple or Google, are responsible for the app, its support and maintenance, and for any claims about it, including product liability, legal or regulatory compliance and intellectual property claims. If you downloaded the app from the App Store and it fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any); Apple has no other warranty obligation to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US government embargo, and are not on any US government list of prohibited or restricted parties. Your use of the stores is also governed by their own terms.

11. Law, disputes and general terms

If a dispute arises, please contact us first at support@smartharmonyai.com so we can try to resolve it informally.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, and disputes will be heard in the state or federal courts located in Travis County, Texas. This does not take away any mandatory consumer-protection rights you have under the law of the country where you live, including the right to bring a claim in your local courts where that law gives you one.

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours to a successor that continues the service. These Terms and the Privacy Policy are the entire agreement between you and us about Portrait Art.

12. Privacy and contact

The Privacy Policy explains how we handle information. Questions about these Terms: support@smartharmonyai.com, or see Support.
